The monthly meeting of the Town Board of the Town of Trenton was held at the Trenton Municipal Center, Barneveld, NY.  Supervisor Mark Scheidelman called the meeting to order at 7:35 p.m.  Present:  Councilmen Shirley Poland, Betsy Mack, Joseph E. Smith; Highway Superintendent Art Hughes; Town Attorney Tom Hughes; Rick Allen, and Sue Stockton with the hats of Joe DeTraglia and Larry Bogan.

 

MINUTES:  The minutes of the October 11, 2006 meeting were tabled.

06-115  Motion by Mack, second by Smith, to approve the August 9th and the October 4th minutes.  Roll call: Poland, aye; Smith, Aye; Scheidelman, aye; Mack, aye.  Motion carried.

 

PRIVILEGE OF THE FLOOR:

Boy Scouts Camporee:  Rick Allen addressed the Town Board to see if the Town would consider letting the Boy Scouts hold their annual Camperee at the Trenton Town Park on October 12, 13 and 14th.  The group may consist of up to 400 scouts and would require the use of both pavilions for the entire weekend.  Allen stated the scouts would camp in the fields.

South Trenton:  Sue Stockton addressed the Town Board to thank Betsy Mack for her assistance with the 501C3.  Stockton reported the South Trenton Community Center is ready for the upcoming youth recreation program.  Scheidelman informed Stockton if South Trenton needed any equipment, to let the Town know.

 

06-116 GENERAL ABSTRACT:  Motion by Kellogg, second by Smith to pay audited General Abstract 06-12 (812-895) in the amount of $125,150.30.  Roll call: Mack, aye; Poland, aye; Smith, aye; Scheidelman, aye.  Motion carried.

06-117 HIGHWAY ABSTRACT:  Motion by Smith, second by Mack to pay audited Highway Abstract 06-12 (332-363) in the amount of $31,092.56.  Roll call:  Poland, aye; Mack, aye; Smith, aye; Scheidelman, aye.  Motion carried.

 

HIGHWAY SUPERINTENDENT:

Town Highway Superintendent reported the Highway employees were busy fixing equipment.

Downer Hill Road:  Hughes informed the Town Board he would be using the 1997 small dump truck to plow Downer Hill Road.  He informed the board the dump truck needs work if it is not going to be replaced.  Scheidelman will review Arts budget.

FEMA:  The Town has received FEMA money in the amount of $10,587.00.

Veteran’s Way:  Verizon is going to move the telephone pole at the Mapledale road end of Veteran’s Way.  Verizon has wires under the road and they will pay to move the pole. Per Rick Ano, this should be completed by the time the Town is ready to pave in the spring.  Dennis Davis, from the County, told Scheidelman a permit has been issued.

Prospect Ambulance:  Scheidelman received a request from the Prospect Ambulance to house one of their ambulances in the old highway garage, or somewhere along the Route 12 corridor, for the winter.  They are experiencing a space shortage until their building is constructed.  Art Hughes informed the Town Board he felt the Highway Department had enough room to temporarily house one ambulance.  He noted the building would need to be locked, the town would need an insurance indemnification rider from the Ambulance and Art would need to have the ability to move the vehicle at any given time if necessary.  Scheidelman replied the new garage would have more people around for security purposes.  Art replied there would be more chance of accidental damages in the new garage.  Further discussion was held with all Town Board Members in favor of assisting the Prospect Ambulance.

 

Scheidelman spoke with Barneveld Fire Chief Wayne Norton.  The village is prepared to build an addition for the Sheriff’s office with the understanding they may move to the Municipal Center in the future.  Scheidelman recommended a three way discussion before anyone builds.

Art Hughes left the meeting at 8:15 at the conclusion of highway business.

 

ZONING: 

Roberts Zoning Application:  Steve Hunter shared concerns of the Roberts zoning application with the Town Board.  The Roberts pole barn currently houses a portable sawmill, etc.  Tom Hughes stated this would be an expansion to a non-conforming use. The letter, submitted by the Robert’s, for the expansion to the pole barn states use for a hay wagon and a lime spreader for agricultural use. Scheidelman stated the Department of Agriculture and Markets have an answer and will send it out this week.

ZBA Decision:  Hunter asked if the Town Board members received a copy of the ZBA’s decision to revoke the Emad variance.  Everyone had a copy.

Zoning Enforcement Officer Agreement with Villages:  Scheidelman spoke with the three villages.  They all agreed the Town would collect the zoning fees.  Scheidelman will have the attorney revamp the contracts with the villages for the first of the year.

Ralph Carmen:  Steve Hunter spoke with Ralph Carmen last week.  The old mobile home has been demolished.  Hunter informed Carmen the mobile home needs to be removed per their September agreement.  Hunter stated this is almost a debris and property maintenance issue.

South Trenton Abandoned Property:  Resident Sue Stockton asked the status of the abandoned house in South Trenton.  Per Ken Cutler’s monthly report a registered letter has been sent to the owner and corrective action is in progress.

Planning Board Meeting:  Hunter reported he attended the Planning Board meeting and has questions regarding the zoning for the parcel previously owned by Penczek Construction.  The zoning line appears to be drawn through the middle of the property.  Mack stated she is waiting for the records clerk to track down the hand drawn map.  Scheidelman replied the original map would have been sent to Harza in order to create the new zoning map.  He told Hunter to follow the interpretation of Zoning Maps found in section 86-18 of the Code Book.

Broomfield:  Hunter questioned the Town Board on the status of the Broomfield proposal for storage.  The Town received a site plan review almost a year ago.  Is there a one-year time limit on site plan review?  The Town Board responded per section 70-13 the proposal would be null and void if construction has not begun within one year.

 

CODES:

Miller Road:  There is an abandoned mobile home at 7670 Miller Road in Holland Patent.  Per Ken Cutler’s monthly report, a registered letter has been sent and compliance is in progress.

Wind Song/Paradise Mountain: Cutler recommends the Town Board approve a 2007 Mobile Home Park application when it is received as Loccisano is really trying to clean up the park.  Al Sheppard is the new Park Manager.

 

NOCCOG:

NIMS:  Gerry Ritter thanked the Town of Trenton for hosting NIMS training.  She reported Fred VanAmee suggested towns put a copy of resolutions and any other NIMS requirements in one folder for easy emergency access.  Ritter reported NOCCOG hopes to have a new part-time circuit rider in January.

 SARA Grant Applications Training:  Ritter is checking with Kent Steutz to find out if NOCCOG can apply for more than one co-operative grant under the new regulations.  She would like to apply for a grant for payroll records.

NYS Law-Training for ZBA & Planning Board Members:  Ritter reported Gene Waterbury devised a training tracking form complete with state statutes for handling training.

Hazardous Mitigation:  Ritter reported a Storm Management workshop would be held at the Trenton Municipal Center on Wednesday, January 24 from 6:30 to 8:30.  Two hours of eligible training credit for Planning Board members could be received.  Each town would have to pass a resolution to count this as part of mandatory training.

Tughill Times: Ritter reported an article in the Tughill Times lists the newly elected officials, noting a strong showing from Oneida County.

 

SUPERVISORS REPORT:

06-118  Motion by Smith, second by Kellogg, to accept the October and November Finance Officer’s Report with an ending balance of $738,879.45.

Roll call:  Kellogg, aye; Mack, aye; Scheidelman, abstain; Smith, aye; Poland, abstain.  Motion carried.

 

TOWN CLERK’S REPORT:  The November Town Clerk’s report was reviewed by the board.  There were total revenues of  $584.45; with $350.42 submitted to the Supervisor. 

 

LOCAL LAW “D”:  The Local Law was tabled at this time.

FERGUSON LEASE:  Scheidelman will redraft the lease and have the attorney review.  Be prepared to vote on this at the December 27, 2006 meeting.

OPEN MEETINGS POLICY:  Scheidelman asked Bob Freeman’s office for clarification on Open Meetings.  An Advisory Committee is not subject to Open Meetings.  If they have Town Board members present the meeting is subject to Open Meetings.  Scheidelman recommended the Town Board consider adopting a policy for all committees and groups under the Town be subject to the Open Meetings Law.  He would then send a general statement to all committees.

COOMBS ROAD BONDS:  The Town needs to provide certification of non litigation for the Bonds to be finalized.

 

ATTORNEY:

Roberts Zoning Violation:  Tom Hughes reported a motion for discovery was filed.  Hughes received an order on consent from Roberts’s attorney. Tom Hughes is waiting to hear from him.

Park Outdoor Advertising:  Tom Hughes will give an update in a week or two.

Attorney Tom Hughes is working on the following: Niagara Mohawk-Monroe County, Sampo, Kevin Ellis, and Craig Loomis.

GENERATOR:  Councilman Joe Smith discussed a couple of quotes for 40-kilowatt generators.  General discussion was held.  The Town Board would like to estimate the cost of 60-kilowatt generators as well.  Scheidelman will check on the procurement policy to see if this purchase would need to go out to formal bid.

 

OTHER ISSUES & REPORTS:

New Local Laws/Amendments:  Scheidelman reminded the Town Board to be prepared for extra meetings for January and February to address several new Local Laws and Amendments.

Hinckley Sewers: Betsy Mack has the USDA application on her desk.  Mickey is working on the figures.

Highway Garage:  Jason Smit, of Smit Engineering, sent a proposal of six options.  Discussion was held and the Town Board would like to have a meeting with Jason Smit.  Scheidelman will set up a meeting.

Housing Survey:  Steve Hunter reported the Housing Survey was complete.

EZ-Stop:  Scheidelman reported EZ Stop would probably show no progress until spring.

ADOPT-A-PLATOON:  The Lions Club will sponsor this month’s shipment to the Platoon.  The shipment is scheduled to go out on November 28.

Brookfield Assessment:  Scheidelman will ask Paul Nolan to write up a proposal for the Town Board to approve.

Sanborn:  Cheese Factory Road is owned by the State of New York as determined in a 1973 agreement.  The Town is only responsible for maintaining the shoulders and culverts, etc.  Sanborn would like to set up an informational meeting with the neighbors for after the holiday.  The Town Board will need to schedule a Public Meeting.

Muni Center:  Scheidelman is waiting for requirements from the Sheriff’s Department.

Delta Dam Hydro:  Paul Nolan reported he has had some interest in the Dam.

Community Education:  Councilman Shirley Poland reported Community Ed has been busy coordinating the play.  Poland will look into money received from the Fall Programs.  Bruce Kellogg asked the status of a search for a sole director.  Poland will look into the matter.

Real Property Index:  Scheidelman reported Jeanette Conte is working on updating all of the 2006 information.  The index should be completed by the end of the year.

Official Map:  Parcel boundaries for the Official Town Map are being worked on.  The County has to change these and they are six months behind.

Low Volume Roads:  Councilman Betsy Mack will see if she can find a sample law.  Highway Superintendent Art Hughes has designated the classes of the town roads.  He stated the town has no minimum maintenance roads.

Assessments:  Discussion was held on assessed values within the town versus asking price.  It was noted that sales values of properties in the town are much higher while the town has held the assessed values down.

 

COMMITTEES:

Planning Board:  Scheidelman reported the Planning Board would be working on Outdoor Wood Burning Boilers, definitions of Hog Farming and Public Parks.  The Villages have banned the boilers. 

Zoning Board of Appeals:  The ZBA submitted copies of their latest decision and meeting minutes.

CAC:  The CAC submitted a proposal to the Town Board asking the town to pay $10.00 per tree and the villages to pay $10.00 per tree to plant small trees under the power lines.  06-119  The Town Board discussed and approved the proposal.  The CAC requested the Town Board publish an article in the paper, or send post cards, explaining the necessity of cutting back and trimming along the edges of the road.  Scheidelman would ask the CAC to draft a letter.  The Town Board would like to meet with the CAC.

Logging:  Scheidelman reported the logger had been in to mark trees for firewood.  He is working on a contract to remove the firewood.  Once the firewood has been removed the loggers could come in.  Smith asked about clearing out the dead trees at the Town Park as well.
